These terms govern use of the linkQr service, published by Createur Digital - Fred Contat, and the sale of the subscriptions giving access to it. Creating an account means accepting them.

1. The service

linkQr creates so-called dynamic QR codes: the code encodes a permanent short link, and the destination each visitor is sent to is decided at scan time by a rule engine (country, device type, language, time window). The service also publishes a link page hosted by us.

The customer may change destinations at any time, without reprinting the code.

2. Account

The account is personal. The customer is responsible for keeping their password confidential and for everything done from their workspace. They must be of age, or have their legal guardian’s permission.

3. Plans and prices

Three plans are offered: Départ, Pro, Agence. What each allows — number of QR codes, scan volume, domains, history depth — is stated on the pricing page, which prevails.

Prices are shown in Swiss francs or euros, at the customer’s choice. They are net prices: the amount displayed is the amount charged. As the publisher is not liable to VAT, no tax is added by them to the announced price.

Prices may change. A change never applies to a running subscription: it takes effect at the next renewal, and the customer is told beforehand.

4. 14-day trial

Every subscription starts with a 14-day trial giving full access to the chosen plan. A payment method is required at sign-up, but no amount is charged during the trial.

At the end of the trial the subscription starts automatically and the first payment is taken. The customer may cancel at any time before that date, free of charge and without giving a reason. The trial is offered once per workspace.

5. Payment

Payments are processed by Stripe, a payment service provider. We never have access to full card details: they are entered at Stripe and held by Stripe.

If a charge fails, Stripe retries several times over a few days. The service keeps working during those retries. Once they are exhausted, the subscription becomes unpaid and article 7 applies.

6. Term, renewal and cancellation

The subscription is monthly or yearly at the customer’s choice, and renews automatically for the same term.

The customer may cancel at any time from their billing page. Cancellation takes effect at the end of the period already paid for: the service remains available until then, and no pro-rata refund is due for the period started.

7. What happens when the subscription ends

This article is the most important in this document.

When the subscription ends — by cancellation, or as unpaid after the retries — the QR codes in the workspace stop redirecting and show a page stating that the link is no longer active. The same applies to the link page. A QR code already printed and distributed therefore stops working.

Nothing is destroyed: destinations, rules and statistics are kept. Subscribing again switches the same links back on, to the same destinations, with nothing to reprint.

Customers are advised to weigh this consequence before printing a QR code on a durable medium.

8. Right of withdrawal

Swiss law provides no general right of withdrawal for distance selling. For consumer customers residing in the European Union, a fourteen-day withdrawal period applies from subscription.

In practice the 14-day trial covers that period and allows the customer to walk away without any amount having been charged.

9. Customer obligations

The customer is solely responsible for the destinations their QR codes point to and for the content of their link page.

They undertake not to use them for phishing, malware distribution, counterfeiting, impersonation of a person or organisation, or any unlawful content. They also undertake not to circumvent their plan’s quotas nor to resell access to the service.

Because destinations can be changed, particular care is required: redirecting a distributed code to content unrelated to what was announced may engage the customer’s liability.

10. Suspension and termination by the publisher

In the event of a breach of article 9, or on a substantiated third-party report, we may switch off a redirect or a page and suspend the account concerned, without notice where the content is manifestly unlawful. Suspension cuts access without deleting data; it can be undone.

11. Availability

We do our utmost to keep the service running, without any contractual availability guarantee or service level commitment. Maintenance interruptions may occur and are announced where foreseeable.

12. Liability

The service is provided as is. We cannot be held liable for indirect damages — loss of business, loss of profit, reputational harm — nor for the consequences of a destination chosen by the customer.

In any event, and save for intentional or gross fault, our liability is limited to the amount actually paid by the customer over the twelve months preceding the triggering event.

13. Personal data

Data processing is described in the privacy policy, which forms an integral part of these terms.

14. Changes to these terms

These terms may change. Any substantial change is notified to the customer, who may cancel before it takes effect if they do not accept it.

15. Applicable law and jurisdiction

This contract is governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of canton of Vaud, Switzerland, subject to mandatory rules protecting consumers in their country of residence.
